Judgment 1. Heard counsel for the petitioner and the State. 2. Petitioner has filed this application for a direction to the respondents to make payment of Rs. 1,09,010/- as he had done repair work of Chapra Reva Ghat Road in the year 1981-1982. Earlier also for similar relief petitioner has filed C.W.J.C. No. 8168 of 1996 which was disposed of by order dated 6.8.1997 directing the petitioner to represent before the Secretary, Road Construction Division and the Secretary was directed to enquire into the matter and if it is found that the petitioner has done the said work, admitted dues should be paid. 3. Petitioners case is that thereafter he filed his representation but no order was passed. Then he filed contempt and during the pendency of the contempt case by order dated 13.1.2004 the Secretary, Road Construction Department has rejected the claim of the petitioner. Petitioner has not been able to produce even a chit of paper that in the year 1981-82 work order was issued in his favour for this repair work. The letter which has been annexed as Annexure-1 is of the year 1987. That letter indicates that before payment approval of the competent authority should be taken. There is nothing to show that the work was allotted to the petitioner. In such case no direction can be issued to the respondents for making payment of the amount which is being claimed by the petitioner which is not admitted rather disputed by the respondent authority. 4. Accordingly this application is dismissed.
