Judgment 1. Petitioner Sorabh Bali, apprehending his arrest in a nonbailable offence in case FIR No.17 dated 7.1.2007 under Sections 420, 406, 506/34 IPC, registered at Police Station City Karnal, has filed this petition under Sec.438 of the Code of Criminal Procedure for the grant of anticipatory bail. 2. On January 25, 2007, interim anticipatory bail was granted to the petitioner subject to his joining investigation. I have heard counsel for the parties and have gone through the contents of the FIR as well as the order dated 11.1.2007, passed by Sessions judge, Karnal, whereby bail application of the petitioner has been dismissed. 3. Counsel for the petitioner contends that the aforesaid FIR was registered on the allegation that the complainant paid Rs.20,000/- to the petitioner in order to make the said amount double. It is alleged that the petitioner promised the complainant to return Rs.40,000/- after ten days. Counsel contends that allegations in the FIR are totally false and the petitioner is ready to join the investigation. 4. Counsel for the petitioner further states that in terms of the interim order dated January 25, 2007, the petitioner has joined the investigation. The State counsel does not dispute this fact and further states that the petitioner is no more required for further investigation. In view of the above, without commenting on the merits, the interim bail, granted vide order dated January 25, 2007, is made absolute subject to the same terms and conditions. Disposed of accordingly.
