Judgment :- Mr.K.Balu, learned Additional Government Pleader, takes notice on behalf of the respondents. 2. In similar matters, directions have been given for release of vehicle, subject to certain conditions. 3. While following the earlier orders of this Court, the first respondent is directed to release the vehicle namely, lorry bearing Registration No.TN-28-J-4162 seized by the 2nd respondent on 12. 2007 to the petitioner on fulfilling the following conditions:- .(i) The petitioner shall establish the ownership of the vehicle, by producing necessary certificates before the first respondent. .(ii) The petitioner shall not alienate the vehicle in any manner till adjudication proceeding is over. (iii) The petitioner shall deposit a sum of Rs.20,000/-(Rupees Twenty Thousand only), in cash within a period of two weeks from today, before the first respondent. .(iv) The petitioner shall give an undertaking that he will not use the said vehicle for any illegal activities in future and also to produce the vehicle as and when required by the respondents; and .(v) It is made clear that if it is found that the vehicle is involved already any such previous offence, this order will not have any effect and it will be open for the respondents to proceed against the petitioner in accordance with law. 4. The writ petition is ordered in the above terms. No costs.
