JUDGMENT 1. - Heard learned counsel for the accused petitioners, learned Public Prosecutor for the State, perused the case diary and other material placed during the course of arguments. 2. It is contended on behalf of the accused petitioners that complainant party was the aggressor and Chandan Singh of the complainant party killed Yogendra by using fire arm about which FIR No. 247/2006 for the offence under sections 302 & 307 IPC was registered and thereafter just to implicate the accused persons again Chandan Singh killed one old man Gangaram, who was his close relative, in a hut and this fact has come in the investigation and charge-sheet has been filed against Chandan Singh for the offence under section 302 IPC and only charge-sheet for the offence under sections 307, 324, 147, 149 & 336 IPC has been filed against the accused petitioners for causing Injuries to other injured person. It is also submitted that none of the accused inflicted any such injury to any injured of the complainant-party which can be said to be dangerous to life. 3. Learned Public Prosecutor vehemently opposed the bail application and contended that Ramveer along with other co-accused Vishambhar fired, at the complainant party and injured Ramsita and Than Singh who received many gun shot injuries. 4. Without making any observations on merits, having considered the rival submissions made at the bar, nature of allegations and injuries, material placed during the course of arguments, entire facts and circumstances and the fact that gun shot injuries to Than Singh have been ascribed to accused petitioner Ramveer and one another co-accused Vishambhar, injured Ramsita also received gun shot injuries, I do not deem it proper to the enlarge the accused petitioner Ramveer on bail but so far other accused petitioners Amar Singh, Harendra and Lokendra are concerned no such allegations have been levelled against them, keeping in view the entire facts and circumstances, I deem it proper to enlarge the accused petitioners Amar Singh, Harendra and Lokendra on bail. 5.

Accordingly, the bail application of Ramveer is rejected and that of the accused petitioners Amar Singh, Harendra and Lokendra is allowed and it is, therefore, ordered that the accused petitioners Amar Singh S/o Banshidhar, Harendra S/o Geetam Singh and Lokendra S/o Geetam Singh in FIR No. 248/2006 Police Station Mania, District Dholpur shall be released on bail provided each of them furnishes a personal bond in the sum of Rs. 20,000/- together with two surety bonds each in the sum of Rs. 10,000/- to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so during the pendency of the trial against them.Bail to R1 and V Refused and Bail Granted to Rest Three. *******
