Judgment 1. Petitioner Satpal Sharma, apprehending his arrest in a nonbailable offence in case FIR No.141 dated 7.10.2006 under Sections 326/ 324/323/427/148/149 IPC, registered at Police Station Tarn Taran, has filed this petition under Sec.438 of the Code of Criminal Procedure for the grant of anticipatory bail. 2. On January 19, 2007, interim anticipatory bail was granted to the petitioner subject to his joining investigation. I have heard counsel for the parties and have gone through the contents of the FIR as well as the order dated 11.1.2007, passed by additional Sessions Judge, Amritsar, whereby bail application of the petitioner has been dismissed. 3. Counsel for the petitioner contends that the petitioner, who is 62 years old and a retired Government employee, has been falsely implicated in the aforesaid case. He further contends that as per the allegations in the FIR, only lalkara has been attributed to the petitioner in the cross-case and the main accused Rupinder Kumar, to whom grievous injuries have been attributed, has been granted regular bail. 4. Counsel for the petitioner further states that in terms of the interim order dated January 19, 2007, the petitioner has joined the investigation. The State counsel, after having instructions from Paramjit singh ASI, does not dispute this fact and further states that the petitioner is no more required for further investigation. 5. In view of the above, without commenting on the merits, the interim bail, granted vide order dated January 19, 2007, is made absolute subject to the same terms and conditions. Disposed of accordingly.
