Judgment 1. Petitioner Sukhdev Singh alias Bhutto alias Ajay Kumar has filed this petition under Sec.439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No.41 dated 9.2.2004 under Sections 406, 420 IPC, registered at Police Station Shahkot, District Jalandhar. 2. I have heard counsel for the parties and gone through the contents of the FIR as well as the order dated 18.1.2007, passed by additional Sessions Judge, Jalandhar, whereby bail application of the petitioner has been dismissed. 3. In the aforesaid case, at one stage, petitioner was declared proclaimed offender and he was subsequently arrested on 19.12.2006. Counsel for the petitioner contends that supplementary challan has already been filed and the other co-accused are on anticipatory bail. He further contends that till date, no prosecution witness has been examined in this case, which is triable by Magistrate and the trial is not likely to conclude soon. The material facts have not been disputed by the State Counsel. 4. In view of the above, without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner and he is, accordingly, ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of the trial court.
