Judgment S. S. SARON, J. 1. The petitioner, by way of the present petition under Section 482 of the Code of Criminal Procedure (`cr. P. C. for short) seeks direction to the respondents to submit final report in terms of Sec.173 Cr. P. C. in case FIR No.395, dated 28.10.1996, registered at Police Station Sadar, ludhiana for the offence under Sec.307,34 of the Indian Penal Code (ipc for short ). The offence under section 307 IPC was later on converted into Sec.302 IPC on 2.11.1996. In reply filed by the Senior Superintendent of Police, Ludhiana, it is stated that necessary cancellation report has been filed in the Court of sh. Sanjay Agnihotri, Judicial Magistrate Ist Class, Ludhiana on 12.4.2003. It is further submitted that the complainant Smt. Asha Jethi, was summoned but she had already died on 1.11.1996. One of the accused in the case 2. Ashok Jethi had also died on 26.3.2000. In view of the afore said facts, learned counsel for the petitioner states that she may be allowed to withdraw this petition so as to enable her to raise her grievance before the Court where the cancellation report has been filed. Dismissed as withdrawn.
