ORDER : B.N. Agrawal and P.P. Naolekar, JJ. - State of Tamil Nadu 1. Perused the latest status report filed on behalf of the State of Tamil Nadu, in which it has been stated that 38 persons have not vacated the Government accommodation. It has been stated that with regard to 13 persons, cases are pending in the High Court and the civil court. The State of Tamil Nadu shall file petitions before the courts concerned within one month from today for disposal of the cases. Upon filing of such petitions, the High Court and the civil court will see that the cases are disposed of within a period of six months from the date of filing of the petitions and along with the petitions, copy of this order shall be filed by the State of Tamil Nadu before the respective courts. So far the other occupants are concerned, it appears that simply notice has been issued and no steps whatsoever have been taken for eviction of the illegal occupants. One week before the next date of hearing, the State must file an affidavit as to what proceeding has been initiated and what is the stage of the same. The State should also state in the affidavit as to what proceeding has been initiated for recovery of penal rent. 2. List on 1-8-2007. State of Andhra Pradesh 3.
