ORDER 1. They are heard on admission. 2. An application for eviction was submitted by the respondent who is the widow under Chapter III-A section 23-A of M.P. Accommodation Control Act, 1961. The Rent Controlling Authority issued summons to the applicant/tenant, but admittedly he failed to submit application for obtaining leave to appeal as envisaged under section 23-C of the said Act. Eventually, under the deeming clause the Rent Controlling Authority has passed the order of eviction. 3. Since no application to obtain leave to appeal was filed by the applicant within 15 days or even thereafter I do not find any illegality in the impugned order. This revision petition is dismissed summarily.
