ORDER 1. Shri N.K. Patel, learned senior Advocate is heard on office note. 2. This review petition was placed before Additional Registrar (Judicial) on 16.5.2007 as certified copy of the judgment passed in First Appeal No. 45/2002 decided on 10.4.2007 has not been annexed with the memorandum of review application. The default which has been pointed out by Registry is that along with review petition, certified copy of the judgment of which review is sought, should be accompanied. 3. Shri Patel, learned senior counsel invited my attention to the High Court Rules Section 1 Chapter IV which pertains to Court hours and presentation of appeals and applications. By inviting my attention to Rule 4 (2) of the said Chapter of the Rules, it has been submitted by learned senior counsel that there is specific provision to accompany certified copy of the decree appealed from or sought to be revised and of the judgment or order on which the decree is founded. But, the rule does not say that if a review petition is filed then also certified copy of the judgment or order of which the review is sought is to be accompanied along with memorandum of review application. 4. By inviting my attention to Rule 16 (1) of the said rules, it has been contended by learned senior counsel that affidavit shall be accompanied along with review application only when the review is sought on the ground of the discovery of new and important evidence. The prescribed period of limitation of filing a review application is 30 days under Article 124 of the Indian Limitation Act. The present review application has been filed on 8.5.2007 i.e. within 30 days. 5. Looking to the above said provision, Registry objection is hereby overruled and it is hereby held that certified copy of the impugned judgment passed in FA No. 45/2002 is not required to be filed along with review application, since under Rule 4 (2) of Chapter IV of section 1 of the said Rules, no such certified copy is required to be filed along with review application, if the same is properly presented within 30 days. 6. Similarly, affidavit is also not required to be accompanied along I with review application as the review has not been sought on the ground of the discovery of new and important evidence. 7.

In this view of the matter, the objection of Registry is hereby overruled. 8. Shri B.P. Sharma, learned counsel, takes notice on behalf of respondent No.1 (a) to 1 (g)/defendant. 9. Shri D.S. Baghel, Dy. Govt. Advocate, accepts notice on behalf of respondent No.2. 10. Let copy of review application be supplied to Shri Baghel, learned Dy. Govt. Advocate. 11. List this case along with MCC No. 1393/2007.
