( 1 ) THE petitioner's only grievance in this writ petition is against non-consideration and disposal of a statutory petition filed by him under Section 164 (2) of the Army Act within the time stipulated for the purpose. Mr. Ramesh, learned counsel for the petitioner draws our attention to Defence Services regulations 365 (j) to submit that the statutory complaint sent to the respondents by Registered AD on 11th December, 2006 ought to have been disposed of by now. ( 2 ) LEARNED counsel appearing for the respondents submits on instructions that given 6 weeks' time from today, the statutory complaint shall be considered and disposed of under intimation to the petitioner, if not already disposed of. In that view, therefore, we see no reason to keep this writ petition pending. The writ petition is disposed of with the direction that the statutory complaint filed by the petitioner, a copy whereof is enclosed with the writ petition as annexure P-2, shall be considered and disposed of, if not already disposed of, expeditiously but not later than 6 weeks from today under intimation to the petitioner. No costs.
