Judgment 1. By this writ petition under the category of the Public Interest Litigation under Article 226 of the Constitution of India, the petitioner has brought into focus the issue of inordinate delay in completing the work of Durgawati Reservoir Project, the work of which has been stopped by the authorities. 2. The following aspects may be highlighted, which are not in controversy: (1) That the project in question is a big one and the construction of the Project work is, virtually, 80% or above completed. (2) The work has been stopped in view of the fact that there have been some procedural lapses and irregularities in not obtaining the requisite permissions and approval or no objection from the concerned competent authorities as required under the provision of law, for example, Wild Life (Protection) Act and Forest Conservation Act. (3) The respondent-authorities are, also, anxious, as stated by the learned Advocate General, which is not disputed, to see that the project is completed, as early as, possible after completing the necessary requisite formalities. 3. The learned Counsel for the petitioner is right in saying that the respondent-authorities should be directed to expedite the requisite formalities so that the vital project, like, the Durgawati Reservoir Project is completed for the benefit of the people of the State of Bihar at the earliest and we agree with this submission. 4. The learned Advocate General Mr. R K. Shahi has, also, with candour stated before us that the Government is itself anxious to complete and expedite the project. In this view of the matter, no further direction is sought. 5. Therefore, the petition shall stand disposed of in the light of the aforesaid observations. 6. Before parting with the order, let it be mentioned that such a vital and important project, if again by any reason, is delayed unreasonably then it will be open for the parties to move this court. 7. With this observation, this application shall stand disposed of.
