Karumbi v. Thalayolaparambu Farmers Co operative Bank

2007-11-16

THOTTATHIL B.RADHAKRISHNAN

body2007
JUDGMENT : 1. Heard learned counsel for the petitioner and learned Government Pleader. According to the petitioner, she filed a Revision before the Co-operative Tribunal and that the Secretary of the Tribunal is not receiving it on the premise that is it time barred. According to her, she has filed it within the time prescribed, going by the date of her knowledge of the award of the Arbitrator. She relies on a couple of decisions of this Court in support of her contention. I am sure that this is not a matter on which the Secretary of the Co-operative Tribunal has to decide, because, even if the case is to be dismissed as time barred, it is within the exclusive domain of the functions of the Tribunal. Hence, on production of a copy of this judgment, the revision of the petitioner will be placed before the Tribunal for orders and the petitioner, through counsel, will be extended an opportunity of being heard before a final decision is taken in the matter by the Tribunal.
