JUDGMENT Surya Kant, J.(oral):-The prayer in this petition is to release the petitioners on regular bail in FIR No. 325 dated 3.11.2006, registered under Sections 148/149/323/325/341/427/392/307/506 IPC and 25 Arms Act at Police Station, Sadar Kaithal. 2. From the genesis of the allegations, it appears that there is a dispute regarding the possessory rights over a big chunk of land owned by the Dera. Some villagers claimed themselves to be Pattedars of the land and in order to assert their possession, they are alleged to have forcibly entered the land and attacked the Mahant of the Dera and his associates. 3. As far as petitioners No. 2 and 7, namely, Mana son of Rania and Jagdish son of Surja are concerned, their names do not figure in the FIR and obviously no injury whatsoever has been attributed to them. It appears that they have been involved subsequently on the basis of statements under Section 161 Cr.P.C. 4. Insofar as petitioners NO. 1,3, 5 and 6 are concerned, no specific injuries have been attributed to them in the FIR. It is alleged that during the course of investigation, it has been found that while one of them (Shamsher-petitioner NO.5) gave Lalkara, rest of them gave simple injuries to the complainant party by using blunt weapons, like lathi. 5. As far as petitioner NO. 4 is concerned, though his name is not mentioned, however, he is stated to have caused a Gandasi blow on the knee of Jagar Singh which too has been found to be simple in nature. 6. After hearing learned counsel for the parties and having regard to the nature of allegations made against the petitioners and without expressing any views on merits of the case, lest it should prejudice either of them, this petition is allowed and the petitioners are directed to be released on bail to the satisfaction of the Chief Judicial Magistrate, Kaithal.
