Judgment J. R. GOYAL, J. ( 1 ) THIS bail application under S. 439 Cr. P. C. has been filed by the accused-petitioner in FIR No. 185/06 registered at Police Station Udyog Nagar, bharatpur for the offence under S. 420, 467, 468, 471 and 120b IPC. ( 2 ) HEARD learned counsel for the accused- petitioner, learned Public Prosecutor for the state and perused the material produced during the course of arguments. Learned Public Prosecutor opposed the bail application. It was, inter alia, contended that the truck bearing registration no. RJ22g 3215, which was in the name of accused-petitioner, was given to Anil and Sunil on the condition that they shall pay Rs. 15,000/- per month to the accused-petitioner apart from depositing the monthly loan-instalment. It was then contended that the co-accused Sunil and Jal Singh have been bailed out by the Additional Sessions Judge, Bharatpur. Learned Public Prosecutor opposed the bail application. ( 3 ) WITHOUT expressing any opinion on the merit, having considered the rival submissions made at the Bar, taking into consideration all the facts and circumstances, I deem it proper to grant bail to the accused-petitioner. ( 4 ) IN the result, this bail application is allowed and it is directed that accused-petitioner prakash Chand Soni son of Ratan Lal, be released on bail provided he furnishes a personal bond in the sum of Rs. 20,000/- together with two sureties in the sum of Rs. 10,000/- each to the satisfaction of the trial court for his appearance before that court on all dates of hearing until conclusion of the trial. Petition allowed. .
