( 1 ) IN this petition for a writ of mandamus, the petitioner seeks a direction against the respondents to convene a committee of specialists like neurophysicians, Paed Neurophysician, Neurosurgeons and Paediatrician drawn from appollo Hospital, All India Institute of Medical Sciences and from Army Hospital (Randr) to diagnose the Brain Stem problem of the petitioner's son Master Adarsh dikshit, a six year old boy who is presently undergoing treatment in the Army hospital at Dhaula Kuan. A further mandamus directing the respondents to investigate the negligence, if any, in the treatment of the patient has also been prayed for. ( 2 ) WE have heard the learned counsel for the parties at some length and perused the record. Mr. Ramesh submits on the instructions of the petitioner who is also present in person that the petitioner shall be satisfied in case the child is directed to be shifted for further treatment to the All India Institute of Medical Sciences. He submits that the Army Authorities could be directed to make the requisite arrangements for an ambulance and coordinate with authorities in AIIMS to ensure that the child is admitted in the concerned speciality for further treatment. ( 3 ) MS. Monika Garg, learned counsel for the respondents no. 1,2 and 4 to 6 has no objection in case the child is directed to be shifted to All India institute of Medical Sciences for further treatment. She submits that if the petitioner was not satisfied by the treatment being given to the child, it was open to her to have the child admitted to the All India Institute of Medical sciences in which event the authorities would lend whatever assistance is possible to have the child transferred in an ambulance to the All India institute of Medical Sciences. ( 4 ) MR. Mukul Gupta, counsel for the All India Institute of Medical Sciences is not available today. We, however, see no reason why the disposal of this petition should be delayed on account of his absence. This is particularly so because all that we propose to direct is the admission of the child who it appears is placed on Dangerously Ill list of the patients in the Army Hospital.

In the circumstances, therefore, we dispose of this writ petition with the direction that the Army Hospital Authorities where the child is admitted at present shall arrange to have the child transferred for admission and further treatment to the All India Institute of Medical Sciences. The Director of All india Institute of Medical Sciences shall ensure that the child is taken into the care of the Institute and given whatever treatment is possible. ( 5 ) IN so far as the remaining relief prayed for by the petitioner are concerned, we consider it unnecessary to deal with the same as Major K. Ramesh has, on instructions, given up all other prayers. Liberty is, all the same, given to the father of the child who is serving in 422 Field Ambulance Unit at sadar Bazar, Delhi Cantt. to seek a suitable posting from the authorities concerned in which event the authorities are expected to examine the request sympathetically and pass appropriate orders.
