(1) or sub-sec. (2) of Sec. 135. When there was no challenge before the Tehsildar then it can be found that it was an order passed under Sec. 135(1) and so, the appeal against that order would be competent to the Land Records Officer under Sec. 75(1)(d). The Collector of the District is the Land Records Officer under Sec. 20(a)(i). The appeal is not competent to the Collector under Sec. 75(1)(a) as under Cl. Admittedly, the mutation is a matter relating to the Land Records or connected with the Land Records. In Sec. 24(viii), it is provided that the Tehsildar shall be sub-ordinate to the Land Records Officer, so, the appeal to the Collector in his capacity as Land Records Officer would be competent against the order of the Tehsildar. So far as the disputed cases are concerned, the appeal against the order of the Land Records Officers shall lie under Cl. (f) of Sec. 75(1) to the Director of the Land Records in the matter connected with the land records. The notification dated 11.9.1947 providing for appeal would be contrary to the provisions of the Land Revenue Act. As the notification provides that the appeal against the order of the village panchayat shall lie to the Collector under Sec. 75(1)(a), it may be stated that the village Panchayat shall act as Land Records Officer under Sec. 135(2) and it can be said that as the Land Records Officer, if an order is passed, then such an order of the Panchayat would only be appealable under Sec. 75(1)(f) to the Director of Land Records and not to the Collector. No appeal, would be competent in disputed cases under Sec. 75(1)(a). However, so far as the present case is concerned.
