( 1 ) THIS petition filed in public interest prayed for the following reliefs: " (A) Issue a writ order or direction in the nature of certiorari or any appropriate writ, order or direction quashing the notification No. 69/2003-CE dated 25. 8. 2003 read along with 8/2004 dated 21st January, 2004 whereby the executive Authority had restored subsidies and exemptions to the manufacturers of Gutka and chewing tobacco products. (B) Issue a writ order or direction in the nature of certiorari or any appropriate writ, order or direction quashing other notification of Central excise extended to manufacturers of Pan Masala. (C) Issue a writ order or direction in the nature of certiorari or any appropriate writ, order or direction quashing other notifications granting central Excise exemptions to tobacco and related products. (D) Issue a writ order or direction in the nature of mandamus or any appropriate writ, order or direction directing the Respondents to create a tobacco Injuries Fund. " ( 2 ) LEARNED counsel for the respondents submits on instructions that the impugned notification mentioned in para 'a' of the prayer part extracted above have since been withdrawn by the Government. ( 3 ) IN that view, therefore, nothing really survives for consideration in this petition which fails and is hereby dismissed but in the circumstances without any order as to costs.
