JUDGMENT 1. - 1. Heard learned counsels for the parties. 2. Mr. Sunil Kumar Singodia, the learned counsel for the petitioner has contended that punishment is merely of one year and, therefore, alleged offence is minor one. 3. On the other hand, learned Public Prosecutor Mr. Arun Sharma has contended that the petitioner is said to have used gas-cylinders for commercial purpose, although the gas-cylinders were meant for domestic use only. Thus, the petitioner has violated the provisions of Section 3/7 of E.C. Act. 4. Without expressing any opinion about the merit or demerit of the case but agreeing with the contention raised by learned counsel for the petitioner, this Court is inclined to grant benefit of anticipatory ball to the petitioners under Section 438 of Code of Criminal Procedure. 5. Therefore, the Investigating Officer of the Police Station, Chirawa. District Jhunjhunu, is directed that in the event of arrest of the petitioner Satish Kumar S/o Shri Guljhari Lal, in FIR No. 61/2008 registered under Section 3/7 of the Essential Commodities Act, he shall be enlarged on ban, provided he furnishes a personal bond in the sum of Rs. 50,000%- (Rs. Fifty Thousand Only) with two sureties in the like amount to his satisfaction on the following conditions : (i) He shall make himself available for the interrogation by Investigating Officer as and when required; (ii) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as 1 dissuade him from disclosing such facts of the court or to any Police Officer; (iii) He shall not leave India without the previous permission of the Court. *******
