ORDER 1. Heard learned counsel for the petitioner. There is no representation on behalf of the respondents. 2. The respondents-Electricity Board are not deciding or passing any order on the representation of the petitioner which has been filed by him way back on 15.7.2004 contained in Annexure-9. This is an objection against the tentative gradation list where the name of the petitioner has not been incorporated but has been kept in abeyance. When the petitioner filed this writ application against the inaction of the respondents in May, 2006 the respondent-Electricity Board would not file a counter affidavit for more than two years. This is yet another case of glaring inaction on the part of the respondents which has brought litigation to the Court and the Court is not being assisted by the respondents by filing suitable reply to decide the issue. 3. The Court therefore disposes of the writ application with a direction upon the Chairman of the Bihar State Electricity Board, respondent No. 1 that he shall call the file of the petitioner and get the representation dated 15.7.2004 contained in Annexure-9 examined and thereafter pass an appropriate order which shall be communicated to the petitioner preferably within a period of three months. 4. The Court is saddling the responsibility upon the Chairman of the Board so that he also gets a test of additional responsibility upon him in a matter which should have been attended to by such other minions of the Board who are getting salary and perks without shouldering responsibility. 5. Let a copy of this order be communicated to the respondent No. 1 at the earliest for needful. 6. This writ application is disposed of with the above direction.
