JUDGMENT :- This Court, by its order, dated 2. 2003, had dismissed the Second Appeal No.24 of 1993. Hence, the appellant in S.A.No.24 of 1993, had preferred a Review Petition No.165 of 2004, before this Court, praying that this Court may be pleased to review the order, dated 2. 2003, made in S.A.No.24 of 1993. Pending the Review Petition No.165 of 2004, a civil miscellaneous petition No.485 of 2008, has been filed under Order XXIII Rule 3 of the Civil Procedure Code, signed both by the parties and the counsels appearing on their behalf, to record the memorandum of compromise and to pass a compromise decree in terms of the Memorandum of Compromise. 2. The terms and conditions of the compromise is as follows: "a) The land situated at Palladam Taluk, Karumathampatti Village in S.F.No.483/3 to the extent of 11.25 acres in which an extent of 5.62 acres of land in New S.F.No.483/3B1 within the following boundaries: North by - Chinia Gounder Land East by - North South Road South by - Tamil Nadu Engineering College West by - S.F.No.699 land in this middle An extent of 5.62 acres of land with the pathway rights and other rights, morefully described and scheduled in O.S.No.206/91 pending on the file of District Munsif Court, Coimbatore subject matter in the above second appeal will absolutely vest with this petitioner as exclusive and absolute owner of the property. b) The respondent herein or her power agents men, authorities or representative or any other person claiming through her relinquishes all her rights title claim over the said property. c) For the said relinquishment the respondent receives a sum of Rs.2,00,000/- from the petitioner herein as consideration. d) The respondent herein or his legal representative or attorneys or servants or any other person claiming through her have no right title or any other claim over the suit property nor they will claim so in future. In the foregoing circumstances it is therefore prayed that this Honble Court may be pleased to record the above Memorandum of Compromise and terms of the same and pass a compromise decree and thus render justice." 3. In view of the above Memorandum of Compromise, this Review Petition No.165 of 2004, is disposed of on the above terms. The affidavit with the above terms of the compromise filed in C.M.P.No.485 of 2008, shall form part of this order.
