JUDGMENT Heard the learned advocate for the applicant and the learned A.P.P. for the State. 2. The applicant is seeking bail in CR No.369 of 2007 of Parksite Police Station, Mumbai. The said case is mainly under Section 302 of IPC. 3. It is the prosecution case that four persons including the applicant assaulted deceased Ramdas. Due to the said assault, deceased received injury on the head. The deceased died 13 days after the incident. 4. In the FIR, it is stated that Vinay Mishra assaulted Ramdas on head with bamboo, one other person assaulted with bamboo on the face and two other persons assaulted with fist and kick blows. The applicant has not been named in the FIR. No witness has named the applicant in his statement. The learned APP has admitted that there was no material to show that the applicant is the one who assaulted Ramdas with bamboo on face. Ramdas had received only two injuries in the incident, one on the head and the other was on the upper incisor. There is no material to show that the applicant caused any of these injuries. Ramdas died 13 days after the incident. Looking to all the above facts, I am inclined to grant bail to the applicant. 5. The applicant-Satyendra Udaybhan Singh be released on bail in the sum of Rs.35,000/- (Rs.thirty five thousand only) with one or two sureties to make up the said amount. The applicant to report to Parksite Police Station, Mumbai once in a week till conclusion of the trial. 6. Application is disposed of. xOrdered accordingly .
