JUDGMENT : The petitioner is an accused for the offence under Sections 341, 323 and 307/34 of the Indian Penal Code read with Section 3/4 of the Prevention of Witch (Daain) Practices Act. Heard learned counsel for the petitioner and learned counsel for the State. It is submitted on behalf of the petitioner that the instant case is totally misconceived against the petitioner and even otherwise, the allegations do not confirm that the petitioner had caused any grievous injury whatsoever to the victim lady and that there was any intention to commit the murder of the victim lady in fact except grievous injury on the wrist, the victim lady has admittedly not sustained any injury in any vital part of the body. It is lastly submitted that the petitioner has been suffering detention in custody since 22.07.2008. Learned counsel for the State opposes the prayer for bail. Regard being had to the facts and circumstances of the case, the petitioner above named, is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lohardaga in connection with Lohardaga P.S. Case No. 106 of 2008 corresponding to G.R. No. 316 of 2008.
