Order Heard the counsel for the petitioner and perused the impugned order passed by Sub-Judge-V Ranchi in Title Suit No. 231 of 1998 whereby he has rejected the petition filed by the defendant/petitioner for deciding the maintainability of the suit as a preliminary issue. 2. Without interfering with the impugned order, I dispose of this application with a direction to the. Court below to decide this issue also alongwith the other issues at the time of disposal of the suit.
