JUDGMENT 1. - By an application being I.A. No. 5629/2008 the petitioners seek to implead Sahiram S/o Teja Ram R/o Magro Ki Dhani (Benan), Gram Panchayat Chodha, Tehsil Bilara as party respondent. 2. Having heard learned counsel for the petitioners, the application is allowed and Sahiram S/o Teja Ram is impleaded as party respondent. Amended cause title has been filed, same may be placed at appropriate place in the file. 3. Heard learned counsel for the petitioners. 4. By the instant writ petition under Art. 226 of the Constitution of India, the petitioners seek to challenge the notification dated 15.04.2008 Annex. 18 issued by the respondent Deputy Secretary, Department of Revenue, (Group-I) Govt, of Rajasthan, Jaipur whereby a new revenue village in the name and style "Jairoop Nagar" in Tehsil Bilara, original revenue village Benan, has been created. As per the notification, it appears that the proposed revenue village has population of 330 persons. 5. It is contended by learned counsel for the petitioners that the petitioner earlier filed a writ petition being S.B.Civil Writ Petition No.7217/2007 which came to be dismissed as withdrawn with the liberty to file representation before the respondent No.2 Deputy Secretary, Department of Revenue, (Group-I), Govt, of Rajasthan, Jaipur. Learned counsel submits that in compliance thereof, the petitioners made a representation but despite representation filed by the petitioners, the respondent No.2 Deputy Secretary passed the notification Annex-18 proposing new revenue village as Jairoop Nagar. According to learned counsel Jairoop is Great grand-father of Shri Sahiram and therefore, such name has been proposed by the Gram Panchayat. 6. I have carefully gone through the order Annex.10 dated 19.03.2007 issued by the Slate Govt, which provides guidelines for creating new revenue village and the manner in which the proposal for creating new revenue village is to be submitted. 1 have also gone through the proposal of the Gram Panchayat vide Annex.1 proposing creation of new revenue village in the name of Jairoop Nagar. A copy has been submitted to the Tehsildar in this respect duly signed by majority of the members of the Gram Panchayat suggesting the name of the revenue village as "Jairoop Nagar" giving background history as to how the particular area in which the originally Jairoop Ram settled and thereafter gradually developed in the form of village. 7.

Learned counsel for the petitioners submits that instead of creating a new revenue village in the name of Jairoop Nagar, it could have been Magro Ki Dhani. 8. Be that as it may, a revenue village has been created as per the guidelines provided in Annex.10 and it has already been notified, therefore, in my view, merely because Jairoop Ram is said to have been Great Garnd-father of one Sahiram, it cannot be a ground to say that the revenue village has been created in the name of a surviving person. 9. In this view of the matter, no case for interference is made out. The writ petition is therefore, dismissed. There shall he no order as to costs.Writ Petition Dismissed. *******
