William Kullu v. State of Jharkhand

2008-11-27

AJIT KUMAR SINHA

body2008
Order The present writ petition has been preferred for issuance of an appropriate writ, order or direction in nature of mandamus commanding upon the respondents to immediately and forthwith issue the appointment letter to the petitioner whose name has been approved by the Establishment Committee for appointment on compassionate ground in Class-III post, as the father of the petitioner died on 21.12.1996. 2. The counsel for the petitioner submits that in spite of the decision taken by the Committee, the letter of appointment has not been issued. 3. A specific case has been made out by the respondents in their counter affidavit that the District Committee for compassionate appointment in meeting held on 27.11.1998 recommended the name of Sri William Kullu for appointment on Grade-III post to the District Education Officer, Gumla vide letter no. 779(ii) Estt. dated 8.12.1998. However, when the documents were submitted by the petitioner it was found by the Regional Deputy Director of Education that the name of the petitioner was Illiam Kullu in place of William Kullu in the matriculation certificate produced by the petitioner and hence, on this background the petitioner could not be appointed. 4. Prima facie, it appears and even the petitioner admits that there was some typographical error and the respondent authority has not rejected the representation of the petitioner but only wanted some testimonies with regard to the correct name of the petitioner. 5. Considering the aforesaid facts and circumstances of this case, the petitioner is directed to produce all the relevant original documents and certificates to prove that his name is William Kullu and not Illiam Kullu and respondent authority will accordingly consider it on merits after scrutiny of the documents. Let the same be done within a period of two months from the date of receipt/production of certificate/testimonies which will be produced/ submitted by the petitioner. 6. This writ petition is accordingly disposed of without any order as to costs.
