Order Heard learned counsel appearing for the petitioner and learned counsel appearing for the Respondents. 2. Learned counsel appearing for the petitioner submits that while the petitioner was working as Pump Khalasi in one of the establishments of M/s. Central Coalfield Limited, got retired on 1.7.1997, still retiral dues has not been paid to the petitioner. 3. Learned counsel further submits that a sum of Rs. 2320/- still due to be paid by the respondent which has not been paid to the petitioner. 4. However, learned counsel appearing for the Central Coalfield Limited submits that in the year 1971 one scheme known as 'Family Pension Scheme' came into force but the petitioner did not opt for that and subsequently, in the year 1998 the scheme relating to pension called as 'Coal Mines Pension Scheme' came into force whereby employees were required to make certain contribution and, therefore, a demand notice was issued to the petitioner whereby he was asked to deposit a sum of Rs. 65,698/- but the petitioner instead of depositing the said amount has preferred this writ application whereby he has challenged the demand notice as unwarranted. 5. Learned counsel further submits that all other retiral dues has already been paid to the petitioner. 6. However, learned counsel appearing for the petitioner submits that he will not be raising any dispute over the demand notice rather he would be happy to deposit Rs. 65,698/- before the Project Officer, Central Coalfield Limited, respondent no.5. 7. In view of the submission, this writ application is disposed of with a direction to the petitioner to make a fresh representation in this regard and to deposit a sum of Rs. 65,698/- before the competent authority within a period of three months. Thereupon the competent authority would be taking decision in the matter of payment of the pension and also over the claim of the petitioner of refund of Rs. 2320/- within a period of two months. 8. With the aforesaid direction/observation, this writ application is disposed of.
