ORDER 1. On 29th July, 2008, we passed the following order. "The grievance of the petitioner in this public interest litigation is with regard to rejection to include Bamwal Caste in the Central List of Backward Classes of the State of Bihar by the National Commission for Backward Classes. 2. The scope of judicial review in the matter of findings recorded by the National Commission for Backward Classes is limited. However, that can only be done provided findings of the National Commission for Backward Classes are placed on record. 3. In the interest of justice, we grant time of three weeks to the petitioner to place on record the findings of the National Commission for Backward Classes with regard to non-inclusion of Barnwal Caste in the Central List of Backward Classes of the State of Bihar.” 2. The counsel for the petitioner has not been able to place on record the findings of the National Commission for Backward Classes with regard to non-inclusion of Barnwal Caste in the Central list of Backward Classes of the State of Bihar. 3. In the circumstances, we are satisfied that nothing can be done in high prerogative jurisdiction by us. 4. Writ petition is disposed of accordingly. 5. This will, however, not preclude the petitioner in agitating their grievance before the National Commission for Backward Classes.
