The petitioner, in this petitton, in response to an advertisement dated 3-5.2006 (Annexure P-l) applied for the post of Constable in the Department ot Police (Haryana) under the Sports Quota. As per the advertisement, 3% posts were reserved for Sports quota under Rule 12.16A of the Punjab Police Rules and Government Instructions No. 8/148/2000-6 HGI dated 23.2.2001. 2. The petitioner contends that he had participated in the National Inter School Handball Tournament for the independent school held at Seth Tolaram Batna Academy, Nokha Road, Gangashahar, Bikaner (Rajasthan) which was held by the Central Board of Secondary Education, an autonomous Organisation under the Ministry of Human Resource Development, Government of India. For participating in the said tournament, he was awarded a certificate (Annexure P-2). He has further attached certificates to submit that he was a player of excellence in the field of handball. According to the petitioner, the Handball Association is affiliated to the Haryana Olympic Association and therefore, he is eligible to be considered for selection to the post of Constable under the Sports category. He has further contended that he, as a matter of fact, appeared as a Sports category candidate and passed the physical test as per the terms and conditions specified in the advertisement and thereafter, was interviewed under Roll No. 3359 on 18.8.2006. The final list of selected candidates was declared on 23.4.2007 but the name of the petitioner did not figure amongst the successful candidates. 3. On coming to know this the petitioner made an application under the Right to Information Act and on the basis of the information collected, he submits that he had secured 21 marks whereas the last candidate selected under the Sports Quota had secured 20.5 marks and the waiting list candidate had secured 20 marks. Both these candidates who had secured 20.5 and 20 marks respectively were sent for training whereas the petitioner was ignored. He contends that he was not considered under the Sports category and was considered under the general category and as such, he has been deprived of his Chance of selection under the sports category. He states that since he has scored higher marks than the last candidate selected under the sports quota, he deserves to be appointed under the Sports quota as he fulfills all the qualifications required for the said category. 4.

Upon notice having been issued in this case, the respondents have put in appearance and written Statement has been filed on behaif of respondents No. 1 and 2 stating therein that no doubt, the petitioner had applied for selection to the post of Constable under the sports quota, but on scrutiny of his sports certificate, he was not found eligible under the sports category as he did not fulfill the conditions of Para 3(b)(ii) of the advertisement (Annexure R-l). Consequently his name was considered against the vacancies of General Category in view of Para 7 of the Guidelines for Recruitment of Constables but in the said category also, the petitioner could not come up in the merit list and therefore, was not selected. The respondents have stated that the sports certificates so produced by the petitioner were neither found to be relating to the tournaments, and events organized by recognized National/ State Federation/Association nor were found upto the desired Standard. 5. Replication to the written Statement has been filed by the petitioner wherein it has been contended that the certificate of the petitioner (Annexure P-2) is of the National Level Tournament and he has secured the first place in the said tournament. He has further contended that the respondents have selected a candidate having the same certificate as that of the petitioner in the sports category but have deprived the petitioner of the same benefit. 6. We have heard counsel for the parties and with their able assistance have gone through the records of the case. The facts are not in dispute. The only question which arises for consideration in this case is whether the certificate issued by the Central Board of Secondary Education, an autonomous Organization under the Ministry of Human Resources Development, Government of India (Annexure P-2) is a certificate which can be termed as the one which would fulfill the criteria as stipulated in Para 3(b)(ii) of the advertisement dated 3.5.2006. 7. For the sake of convenience, Para 3(b)(ii) of the said advertisement is reproduced here-in-below: "3. ELIGIBILITY a) Nationality Domicile; xxxxx xxxxx xxxxx b) Education Qualification : i) xxxxx xxxxx xxxxx.

ELIGIBILITY a) Nationality Domicile; xxxxx xxxxx xxxxx b) Education Qualification : i) xxxxx xxxxx xxxxx. ii) Outstanding sports persons only those who have secured position in National school games, National level tournaments, organized by recognized National federations, or who have obtained Ist and 2nd position in State level tournaments organized by recognized State federation/association will be put through physical efficiency test under the existing recruitment rules. The sporting skills of candidates, who clear the physical efficiency test will be tested through the trial games/competitions. Those who are found up to the desired Standard will be permitted to appear in interview. In case sports persons of required Standard are not available such seats shall not be filled in." 8. A perusal of the above paragraph would clearly depict that the requirement of the advertisement was with regard to outstanding sports persons who had secured Position in National Level Tournaments organized by the Recognized National Federation or State Level Tournaments.organized by the Recognized State Federation/ Association. Emphasis is therefore on the Recognized National Federations and State Federation/Association. 1t is not the case of the petitioner that the Central Board of Secondary Education, an autonomous Organization under the Ministry of Human Resource Development, Government of India, is a recognized Association/ Federation by the State of Haryana but his contention is that the tournament is of national level and therefore, the qualifications as required under paragraph 3(b)(ii) of the advertisement stand fulfilled by him. 9. We are afraid, this Submission of the petitioner cannot be accepted as the Central Board of Secondary Education is neither an Association nor a Federation and further, the same is not recognized by the State of Haryana. The said Association is also not affiliated to the Olympic Association of Haryana although the event of handball is duly recognized by the Olympic Association of Haryana. As regards the grant of similar benefit to the other candidates who had also participated in the same tournament and got selected, the counsel for the petitioner was unable to point out any candidate in the selected list attached as Annexure R-3 with the written statement by the respondents, to submit that such a person has been selected under the sports quota. 10. We do not find any merit in this writ petition and the same is hereby dismissed.
