JUDGMENT Uma Nath Singh. J. (Oral):- Heard learned counsel for parties and perused the pleadings. 2. It appears that petitioner’s land was acquired by Improvement Trust in 1976 for a commercial scheme at Batala. Award was passed in 1981. Petitioner applied vide Annexure P-2 dated 11.5.1982 in the category of ‘Local Displaced Persons’ to get a residential plot. He again made application in 1991 in continuation thereof, but his request was not acceded to, and was rejected only on the ground that the Scheme whereunder his and was acquired, did not provide for allotment of a plot under oustees quota. Learned Senior counsel for petitioner submitted that rejection of his application is arbitrary and discriminatory as in two such cases, vide order dated 28.1.1991, Bawa Singh and Sadha Singh were allotted plots in that category 3. On the other hand, learned counsel for Improvement Trust submitted that though the Trust passed a resolution in favour of allotment of a plot to ‘Local Displaced Persons’ but the Government has not accepted that resolution on the ground that under the Scheme in question, there is no provision for allotment of a residential plot to a landowner whose land was acquired. 4. On due consideration of rival submissions, we find considerable force in aforesaid arguements of learned Senior counsel for petitioner. We notice that Government of Punjab issued a Notification on September 18, 1975 for Utilization of Land and Allotment of Plots under Improvement Trust Rules, 1975, which was to apply all over in the case of Improvement Trusts in Punjab. Secondly, petitioner made an application way back in 1982. Rules of 1975 was to apply then, although subsequent thereto in 1983, another set of Rules was notified. Thirdly, if similarly situated two other persons have been accommodated in the category of ‘Local Displaced Persons’, then petitioner is also entitled to get the same benefits. 5. For the aforesaid reasons, we allow this writ petition and direct the Improvement Trust and the Government of Punjab to consider the claim of petitioner and, if found eligible, allot a suitable plot available at Batala within a period of two months from the date of receiving a copy of this order. ------------------
