G.RAJASURIA

body2008
Judgment :- Animadverting upon the order dated 11. 2007, in not granting the recognition for conducting 9th and 10th Classes by the petitioner School, this writ petition is focused on various grounds, the gist and kernel of them could be portrayed thus: Even though in reality, the petitioner School is owning an extent of 6279 sq. ft., the authority arbitrarily and capriciously without even looking into the records, simply assumed and presumed as though the petitioner is owning only an extent of 3829 sq. ft. As such, he prays for quashment of the order and for directing the authority to deal with the matter afresh and issue recognition on merits. 2. The learned Special Government Pleader would submit that the petitioner gave a representation on 30.11.2007, and suitable direction may be given by this Court. 3. Hence, the following direction is issued: "The respondent shall do well to see that it is considering the representation dated 30.11.2007, on merits after giving opportunity of hearing to the petitioner within a period of three weeks from the date of receipt of a copy of this order." 4. Accordingly, this writ petition is disposed of. No costs. Consequently, connected MP is closed.
