Judgment :- G. RAJASURIYA, J. This is a petition filed by the petitioner praying for the issuance of a Writ of Habeas Corpus to direct the respondents herein to produce the detenue herein, viz., K.Gomathi, wife of the petitioner and daughter of the 2nd respondent herein, before this Court and set her at liberty forth with. 2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and perused the materials available on record. 3. At the hearing, the detenue, K.Gomathi, has appeared. She would copiously and candidly, without any hesitation, submit that she was born on 010. 1988. Apparently and obviously, she is a major. She would further submit that she wants to be with her parents, who are present in Court. According to her, there was no alleged marriage between her and the petitioner at any time. Whereas, the petitioner appeared in person along with his Advocate. The petitioner would state that a marriage took place between himself and the detenue, K.Gomathi, on 112. 2007 and that she is the legitimate wife of the petitioner. 4. Be that as it may. Since the detenue, K.Gomathi, is a major, she is at liberty to go with anyone she likes and we are of the considered opinion that this is not a fit case for the issuance of the Writ of Habeas Corpus. The detenue, K.Gomathi, is set at liberty forthwith. The Habeas Corpus Petition is dismissed accordingly. Taking into consideration the fact that something had taken place between them, we would like to refer the matter to the Mediation and Conciliation Centre, High Court, Madras.
