Judgment Jayanta Kumar Biswas, J: This writ petition has been taken out by one Dintaran Sardar in the capacity of secretary of the co-operative society that is aggrieved by the order of the Assistant Registrar of Co-operative Societies, South-24 Parganas dated November 19th, 2007 (at page 33) made under S. 30(3) of the West Bengal Co-operative Societies Act, 1983 deputing an officer for managing the affairs of the society. In view of the provisions in S.23 of the West Bengal Co-operative Societies Act, 1983 the society is a body corporate, and hence it is to sue or to be sued in its own name only. When the society itself is aggrieved, its secretary is not entitled to espouse the cause of the society. That is to say, the society cannot sue through its secretary. For these reasons, I hold that the writ petition is not maintainable. I accordingly dismiss it making it clear that nothing in this order shall prevent the society from taking out an appropriate writ petition for the same relief for which this writ petition was taken out. There shall be no order for costs.
