It is the duty of the court not to proceed with the application if it is made beyond the period of limitation prescribed. The court had no choice and if in construing the necessary provision of the Limitation Act or in determining which provision of the Limitation Act applies, the subordinate Court comes to an erroneous decision, it is open to the court in revision to interfere with that conclusion as that conclusion led the Court to assume or not to assume the jurisdiction to proceed with the determination of that matter. Section 5 of the Limitation Act on the other hand, empowers the court to admit an application, to which its provisions are made applicable, even when presented after the expiry of the specified period of limitation if is satisfied that the applicant had sufficient cause for not presenting it within time. The Court therefore had jurisdiction to determine whether there was sufficient cause for the appellants not making the application for the setting aside of the abatement of the suit in time and, if so satisfied to admit it. ekuuh; mPpre U;k;ky; }kjk ikfjr fu.kZ; 2002 lqizhe dksVZ dslst ikVZ&1 i`"B 475 esa ;g izfrikfnr fd;k gS fd vihy dks izLrqr djus ds laca/k esa gq, foyEc ds fy, ekQh nsus gsrq izLrqr izkFkZuk i= dk loZizFke fu.kZ; vko;d gSA mDr fu.kZ; esa ekuuh; mPpre U;k;ky; }kjk ;g izfrikfnr fd;k gS fd%& Limitation-Limitation Act, 1963-S. 5 and Art. 116(a) - Delay in filing appeal - Interim order passed by the High Court without deciding the application for condonation of delay- Held, where the maintainability of the appeal itself was seriously questioned, the High Court could have avoided passing the interim orders- However, in view of the peculiar facts of the case, Supreme Court not interfering with the impugned interim orders- Direction issued to High Court for deciding the question of delay and maintainability of the appeal first, before proceeding with the appeal any further- Civil Procedure Code, 1908, S. 96 & Ss. 100-01 and 107, Or. 41 R. 3-A, Or. 42 r. 1, Or 43 R.2 - Application for condonation of delay in filing appeal, held must be decided first. 100-01 and 107, Or. 41 R. 3-A, Or. 42 r. 1, Or 43 R.2 - Application for condonation of delay in filing appeal, held must be decided first. ekuuh; jktLFkku mPp U;k;ky; us djrkjflag cuke jktLo e.My ,oa vU; izdj.k esa ikfjr fu.kZ; vkj-ch-ts- ¼13½ 2006 i`"B 78 esa ;g fu/kkZfjr fd;k gS fd& CODE OF CIVIL PROCEDURE , 1908- order 41, rule 3-A(3) and Indian Limitation Act, 1963 - Section 5 - Without Condonation of delay, appeal is not competent - To decide the appeal, the Court is first required to determine the question of limitation and the court may come to the conclusion that the delay can be condoned and thereafter on condonation of delay, the appeal becomes competent.
