Order Now it is reported that in pursuance of the order passed by this Court on 5th February, 2008, the learned Advocate General, Jharkhand, convened a meeting of the concerned officers of the State Government, Jharkhand State Electricity Board (JSEB) and the Central Government and as a result of their deliberations, they have come out with some suggestions and the learned Advocate General has filed a report for implementing the suggestions, subject to the order of this Court. The comments of the report filed by the• learned Advocate General are enumerated below. Three units of Kahalagaon II STPS with installed capacity of 1500 MW and 1.87% with 28 MW equivalent share in the installed capacity are to be commissioned. Three units of 170 MW each of Teesta Hydro Power Station of NHPC are also to be commissioned by the end of March, 2008 and allocation of various beneficiaries of the project, which apparently includes the State of Jharkhand, is under finalization and the State of Jharkhand is also expected to be allotted its share from this project. 2. DVC has entered into an agreement for supply of 150 MW to JSEB for the period from 7.11.2007 to 7.2.2008. In addition, they have agreed to continue the supply till June, 2008. 3. Officials of the Tenughat Vidyut Nigam Limited (TVNL) have also submitted a report dated 13.2.2008 on the basis of which it is found that only one unit of 210 MW is functioning in TVNL and the output is 98.5%. It has been further mentioned in the report that 2nd unit suffered breakdown owing to failure of turbine blades and efforts are now being made for restoration of the working of the second unit which is expected to be operational by 30.6.2008 considering the fact that motor has been sent to BHEL, Hardwar for repairing and fortunately turbine blades have been arranged on loan basis from the State of Karnataka. 4. A report has also been submitted on behalf of the JSEB giving details with regard to the improvement made in the distribution system in the capital of Jharkhand and other parts of the State. Further information have been given about the present requirement of 765 MW excluding the supply of DVC from command area.

In the statement, it has further been indicated that out of required quality of 765 MW, 580 MW power is presently available from different sources and therefore there is shortage of 185 MW. The availability of power to the extent of 580 MW includes 150 MW which the DVC has agreed to supply as well as 130 MW received from the Central Allocation. 5. The Central Government and the State of Jharkhand have assured that they will do their best for reducing the power crisis in the State of Jharkhand by way of maximization of generation from the available resources, and that the DVC has agreed to continue supply of additional 150 MW even after expiry of the period of agreement on 7.2.2008 till further period upto June, 2008. 6. Due to active and sincere efforts made by the JSEB, two units of Patratu Thermal Power Station (PTPS) will become operative in the month of March, April and May. Thus, total additional quantity of 60 MW approximately is likely to be received from Patratu latest by March, May. 7. Due to various preventive measures taken by the JSEB including raids, various illegal connections have been detected and further raids are contemplated for stoppage and reduction of illegal consumption of energy. So far about 30 FIR have been lodged and revenue of more than one crore rupees has been realized during the last week itself. 8. Learned counsel for the DVC has also submitted that they agree to give supply of 150 MW from June, 2008 and assurance has been given in respect of two units of PTPS to be. operative in March/April-May, 2008 and that 60 MW is likely to be received during the March, May, 2008 and best efforts have been made by the Central Government and the authorities of the DVC to improve the power supply and senior officer(s) has been deputed to carry out the job on the basis of the given guidelines. 9.

Thus, in view of the report filed by the learned Advocate General giving suggestions/assurances, as indicated above, it appears that some progress has been made and it would be appropriate for this Court to direct the concerned authorities to act further accordingly with all earnestness keeping in view the measures proposed or suggested in the Memo dated 12.2.2008 so as to make substantial and spectacular improvement in the power supply in the State of Jharkhand. 10. It is noticed from the report that various suggestions have been given by the Central Government in their Memo dated 12.2.2008 which has been considered by the Committee. However, the learned Advocate General. Jharkhand, as well as the learned counsel for the JSEB would again convene further meeting(s) for consideration of the suggestions mentioned in the aforesaid memo dated 12.2.2008 and the Advocate General shall file further report before this Court. Post this case on 3rd March, 2008. This Court records the appreciation of the valuable services rendered by various officers of the Central Government, Damodar Valley Corporation (DVC) and others.
