JUDGEMENT 1. Petitioners in both these two writ applications professed to be students of Dr. Zakir Hussain Primary Teachers Training College of Education, Sultanganj, Patna for sessions bearing between 1981-83 to 1983-85. They have undertaken their studies for two years Primary Teachers Training Course for different sessions from 1981- 83 to 1983-85 and on completion of the said course, they sat for the examination as conducted by the respondent-Bihar School Examination Board. They have come to this Court for publication of their results. 2. Counter affidavit has been filed on behalf of the State in which inter alia stand has been taken that the institution itself was not duly recognized and as such results cannot be published. It was further stated that petitioners have come to this Court after almost 20 years and the writ should be dismissed on the grounds of delay and laches. 3. A supplementary affidavit has been filed on behalf of the petitioners bringing on record order dated 21.11.2008 passed by the Apex Court in the case of the petitioners institution in I.A. Nos. 3-4/2008 in S.L.P. (Civil) Nos. 19147-19148 of 2008. It appears that the recognition as granted to the institution and completed by it was not accepted by this Court as well as letters patent appeal by this Court and as such the said S.L.P. was filed. The said order of the Apex Court clearly directs as an interim measure to publish the results of students of the batches 1979-81 to 1994-95. 4. In view of the aforesaid, these writ applications are disposed of with a direction to the respondent-Bihar School Examination Board to publish the results of the petitioners but the results so published would be issued in endorsement on subject to the result of the S.L.Ps. as mentioned above. 5. The results should be given to the petitioners within one month on production of a copy of this order before the Secretary of the respondent-Bihar School Examination Board. 6. The writ petitioners are accordingly disposed of.
