Judgment :- This petition is filed seeking direction to the learned Principal District and Sessions Judge, Coimbatore to consider and dispose of the bail petitions of the petitioners, on their surrender in connection with Crime No.174 of 2008 on the file of the respondent, on the same day. 2. Heard both sides. 3. Learned counsel for the petitioners would contend that the petitioners have been falsely implicated in the case in Crime No.174 of 2008 on the file of the respondent for the alleged offences punishable under Sections 323, 506 I.P.C. r/w. Sec.3(1)(X) of S.C. & S.T.(PA) Act. He would further submit that in view of the ban under the provisions of SC & ST Act, they could not move an application seeking for anticipatory bail. Therefore a direction may be issued to the Court below to consider the petitioners bail application on the same day of their surrender on merits. 4. Learned Government Advocate (Criminal side) would submit that necessary orders may be passed by this Court as it deems it fit and necessary. 5. Having regard to the facts and circumstances of the case, this Court direct the petitioners to surrender before the court concerned within 15 days and file necessary applications for bail. The Court concerned shall consider the same and pass appropriate orders on merits on the same day of surrender. The petition is ordered accordingly.
