JUDGMENT Jasti Chelameswar, C.J. 1. Application is filed with the prayer as follows: Under the circumstances, it is prayed that Your Lordship may be pleased to admit this petition and restored the Criminal Revision No. 380/03 in its original file which was dismissed for default on 23.2.2007 and/or pass such further or other order or orders as Your Lordship may deem fit and proper. 2. The abovementioned Crl. Revn. No. 380/03 was dismissed by an order dated 23.2.2007 on the ground of non-prosecution by the Petitioner. 3. Heard Mr. I. Uddin, learned Counsel for the Petitioners and Mr. B.S. Sinha, learned Public Prosecutor. 4. It is settled position of law that a criminal case can not be dismissed for non-prosecution/default. Therefore, Registry is directed to list this matter before the appropriate Bench immediately after the Summer Vacation.
