Judgment Kanwaljit Singh Ahluwalia, J. 1. The present revision petition has been filed against the impugned order whereby learned Rent Controller has provisionally assessed the rent. 2. Learned counsel for the petitioners stated that learned Rent Controller has not taken into consideration rent note whereby the rent has been fixed as Rs. 23,000/- per month. Learned Rent Controller has taken the admission of the respondent-tenant into consideration that the rate of rent was Rs. 8,000/- per month. 3. Order of assessment of provisional rent is interim in nature. The parties shall get fair opportunity to adduce evidence regarding determination of the rent. 4. It was held in Rakesh Wadhawan v. M/s Jagdamba Industrial Corporation 2002(1) Rent Control Reporter 514. that any deficiency in the tender can be made good later or any excess paid can be adjusted. Therefore, no interference is called for, by this Court, while exercising revisional jurisdiction under Section 227 of the Constitution. 5. There is no merit in the present revision petition and the same is dismissed.
