Judgment :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate appearing on behalf of the first and second respondents. 2. It is submitted by the learned counsel appearing for the petitioners that all the three petitioners have been working as Assistant Engineers, Selection Grade, in the Panchayat Union, Nagapattinam. In spite of the fact that all the three petitioners have been qualified to be promoted as Assistant Divisional Engineers, they have not been considered for such promotion. However, the persons who were junior in rank to the petitioners have been promoted. 3. At the time of the hearing of the writ petition, the learned counsel appearing on behalf of the respondents had placed before this Court, a communication, in Letter No.26145/Nir.1(2)/2008-1, Dated:26.06.2008, sent by the Chief Engineer (General), High Ways, Chepauk, Chennai-5, which is as follows: "I have to state that the petitioners of the above said case had already promoted from the post of Assistant Engineer to Assistant Divisional Engineer, and they are relieved from the service in the post of Assistant Divisional Engineer at the time of superannuation. The details of the three persons are given below: 4. The learned counsel appearing on behalf of the petitioners has submitted that in view of the communication, dated 26.06.2008, no further orders are required to be passed in the writ petition. Hence, recording the said communication and the submission made by the learned counsel appearing for the petitioners, this petition is closed. No costs.
