Judgment Kanwaljit Singh Ahluwalia, J. 1. Piare Lal, Government Food Inspector, Karnal, on 12.11.1983 at about 3.00 p. m. along with Dr. K. L. Sachdeva had visited the confectionary shop of petitioner and recovered 1 1/2 kg of hard boiled sugar candy, out of which about 600 grams sugar candy was purchased Oy paying Rs.9. The same was sent to the Public Analyst. 2. Dr. K. L. Sachdeva, PW 3 stated that sugar candy was found in contravention of notification dated 9.6.1983. Petitioner was tried and convicted by the Court of learned chief Judicial Magistrate, Karnal and was sentenced to six months rigorous imprisonment and a fine of Rs.1,000. His appeal was also dismissed by the Court of learned Additional Sessions Judge, Karnal. 3. Mr. Gill has brought to my notice that the petitioner has suffered a protracted trial. Firstly he was tried under summary case and later the trial was converted into warrant case and thereby grave prejudice was done to the petitioner. At this stage he has stated that the petitioner has suffered a protracted trial of 24 years. He has further stated that after 24 years sending the petitioner behind the bars will play havoc upon his family. 4. The petitioner, who is running a confectionary shop, has been convicted for a violation of notification regarding storage of sweet candy. The Courts have always erred on the side of reformation of the offenders. Ends of justice will be met in case petitioner is released on probation under the probation of Offenders Act, 1985 on furnishing bonds to maintain good conduct and behaviour for six months under the Prevention of Food Adulteration Act.1985. However, costs of litigation is assessed at rs.10,000. The petitioner shall appear before the Court of Chief Judicial Magistrate, karnal on or before 31.3.2008 and will furnish the bonds to his satisfaction and deposit the costs of Rs.10,000. In default to deposit of costs of litigation, the present revision petition will deem to have been dismissed. 5. With these modifications, the present revision petition stands disposed of.
