JUDGMENT Hon’ble Rakesh Tiwari, J.—Heard learned Counsel for the petitioners, learned Counsel for the respondents, learned Standing Counsel for the State and perused the record. 2. Writ Petition No. 45521 of 2006, Committee of Management, Janta Inter College, Naujheel, Mathura and another v. State of U.P. and others, has been filed by the respondents for quashing the appointment order of Prabandh Sanchalak dated 10.8.2006 appended as Annexure-7 to the writ petition. 3. Writ Petition No. 61241 of 2005, Raman Bihari Bharadwaj son of Sri Hemraj, resident of village and post Naujheel, District Mathura, Chairman General Body, Janta Inter College, Naujheel, Mathura v. Joint Director of Education, Agra Region, Agra and others, has been filed for quashing the notice dated 1.9.2005 and for restraining the respondents from holding elections scheduled to be held on 18.9.2005 pursuant to the aforesaid notice. 4. Writ Petition No. 46698 of 2006, Committee of Management Janta Inter College, Naujheel, District Mathura and another v. State of U.P. and others, has been filed for challenging the validity and correctness of the order dated 10.8.2006 appended as Annexure-16 to the writ petition and for holding election proceedings dated 29.9.2005 of the petitioner as valid and also for allowing the petitioner to take charge of the institution. 5. Janta Inter College Naujheel, Mathura, hereinafter referred to as the Institution, is a recognized institution receiving maintenance grant from the State Government. It is run and managed by the Committee of Management elected in accordance with the approved Scheme of Administration. 6. The last elections of the Committee of Management of the institution are said to have been held on 26.9.2001 in which respondent No. 3 Sri Narain Dutt Pathak was elected as the Manager of the Committee of Management besides other office bearers. 7. However, one Sri Anil Kumar claimed himself to be the Manager of the Committee of Management in the elections held on 26.9.2001, hence a dispute arose between two rival Committees of Managements. 8. In the aforesaid writ petition Sri Narain Dutt Pathak filed counter affidavit and admitted the petitioner as the Chairman of the General body and one Mahendra Pal was elected as Secretary of the General body vide resolution dated 26.9.2001. The petitioner being Chairman cancelled the earlier list and sent now a list of members to the District Inspector of Schools and also appointed Election Officer. In the above backdrop, Civil Misc.

Writ Petition No. 3950 of 2001, Committee of Management Janta Inter College v. Regional Joint Director of Education and others was filed by Sri Anil Kumar before this Court. 9. During its pendency, the Regional Joint Director of Education vide his order dated 5.2.2004 approved the Committee of Management headed by respondent No. 3 Sri Narain Dutt Pathak as validly elected Committee of Management. Subsequently, the District Inspector of Schools vide his letter dated 7.2.2004 attested the signatures of Sri Narain Dutt Pathak as the Manager of the Committee of Management. The Writ Petition was, therefore, dismissed vide order and judgment dated 13.7.2004 as having become infructuous. 10. It is submitted by the Counsel for the petitioner that in the meeting of the general body dated 18.6.2004 Raman Bihari Bharadwaj had wrongly been removed from the post of President along with Secretary and Treasurer. According to the petitioners, these proceedings were discarded by the DIOS vide order dated 12.8.2005 as such subsequent elections had been held by Sri Sarvesh Kumar on 18.9.2005 as President in which Sri N.D. Pathak was elected as Manager. In so far as the proceedings of election dated 29.9.2005 are concerned, it is stated that they were elected pursuant to proceedings initiated by Sri Raman Bihari Bharadwaj in which he was elected as Manager. Thus root of the dispute in the present writ petition lies in the two set of elections held on 18th September, 2005 and 29th September, 2005. 11. According to the petitioner these proceedings were forged and were discarded by the DIOS vide order dated 18.8.2005 and subsequently elections were held on 18.9.2005 pursuant to proceedings held by Sarvesh Kumar as President. It is stated that in so far as proceedings of elections dated 29th September, 2005 are concerned, they had been initiated by Raman Bihari Bhardwaj the petitioner which were challenged in Writ Petition No. 61241 of 2005, Ram Bihari Bharadwaj v. Joint Director of Education, Agra Region, Agra and others. 12. Papers regarding the aforesaid elections dated 18.9.2005 held by the rival parties of Committee of Management were forwarded by the DIOS. The Regional Level Committee passed an order dated 10th August, 2006 recognizing the election dated 18.9.2005. 13.

The order aforesaid dated 10th August, 2006 has been challenged in Writ Petition No. 46698 of 2006 by Raman Bihari Bhardwaj before this Court for a direction to decide the validity of election dated 29th September, 2005. In view of the interim order dated 15th September, 2005 he held that the said recognition of the election dated 18th September, 2005 shall be subject to the decision of Writ Petition No. 61241 of 2005 and till the writ petition is decided and till then the Associate DIOS was appointed as authorized controller. 14. In so far as Sri N.D. Pathak is concerned, he filed Writ Petition No. 45521 of 2006 challenging the appointment of Prabandh Sanchalak claiming to run the institution. He claimed that in the meeting of general body held on 8.6.2004 the petitioner Raman Bihari Bharadwaj was removed from the post of President along with Secretary and the Treasurer. It is also claimed by him that Raman Bihari Bharadwaj was replaced by the Vice President. 15. Against the aforesaid judgment dated 13.7.2004 in Writ Petition No. 3950 of 2001 defective Special Appeal was filed which is pending and even the delay has not been condoned therein. 16. The impugned order is assailed on the ground that order dated 18.6.2004 is vague and not in inconformity with the Scheme of Administration. He then submits that the impugned order suffers from vice of arbitrariness as the authority has completely ignored two orders of the DIOS dated 12th August, 2005.

Thus the argument of the Counsel for the petitioner on the basis of the above is that the Scheme of Administration authorizes the President to initiate proceedings for election and as such the election which has been initiated by his Committee of Management ought to have been recognized having been held by the Out-going President. He has also placed reliance upon the agenda dated 10.6.2004 of the meeting and submits that in fact there was no agenda for removing the petitioner and the other office bearers from office.

Sri Ashok Khare, learned Senior Counsel for the petitioner has then referred to the record of Writ Petition No. 46698 of 2006, Committee of Management, Janta Inter College, Naujheel, District Mathura through its Manager Raman Bihari Bharadwaj and another v. State of U.P. and others. He has drawn attention of the Court to Annexures 8 and 9 to the writ petition i.e. two letters dated 12.8.2006 of the DIOS to the ‘Sabhapati’ of General body Janta Inter College and urged that these letters had been issued by the DIOS after considering the facts and circumstances of the case and material on record and other documents sent by the petitioner Raman Bihari Bhardwaj in accordance with clauses 4 and 5 of the Scheme of Administration and whereas the list and documents sent by respondent Nos. 4 and 5 have been treated to be in contravention and not governed by clauses 4 and 5 of the Scheme of Administration. 19. The Counsel for the petitioner has then placed order dated 10th August, 2006 impugned in Writ Petition No. 46698 of 2006, aforesaid and urged that the Regional Joint Director of Education, Agra had illegally and arbitrarily appointed the Committee of Management of respondent Nos. 4 and 5 said to have been elected on 18.9.2000 but in view of the interim order dated 15.9.2005 passed by the High Court in another Civil Misc. Writ Petition No. 61241 of 2005 appointed the DIOS as the authorized controller to manage the affairs of the institution. 21. Thus in short the contention of the learned Counsel for the petitioner is that the impugned order is an unreasoned order as it proceeds upon presumption that proceedings dated 18.6.2004 are violated and fail to consider whether they are in conformity to the Scheme of Administration. It is contended that the impugned order having been passed completely ignoring the orders dated 12.5.2005. 23. Per contra, Sri Vasishtha Tiwari, learned Counsel for the respondents submits that the meeting of the general body was held for election of Sabhapati which was not related to the affair of the Committee of Management as per clause 4 of the Scheme of Administration. He submits that the interim order dated 15.9.2005 in Writ Petition No. 61241 of 2005 was extended from time to time and that as the matter relates to factual dispute of election which can be adjudicated by taking oral and documentary evidence. 24. From perusal of the record and the Scheme of Administration it appears that it is the general body of the society which has to initiate the proceedings for holding election of the Committee of Management and not the President. Petitioner Sri Raman Bihari Bharadwaj having been ousted by the general body of the society had therefore, no authority to proceed with the election on the basis that he was a Vice-President of the Committee of Management as the Committee of Management does not come into picture according to the Scheme of Administration. Therefore, the conclusion irresistible is that as Sri Raman Bihari Bharadwaj was ousted by the general body he could not have initiated the proceedings of election of the Committee of Management hence, there is no illegality or infirmity in the order impugned. 25. For the reasons stated above, Writ Petition No. 61241 of 2005 for quashing the notice dated 1.9.2005 and for restraining the respondents from holding elections scheduled to be held on 18.9.2005 is dismissed as elections have already been held pursuant to the aforesaid notice. 26. As regards Writ Petition Nos. 46698 of 2006 and 45521 of 2006 for quashing the order dated 10.8.2006 by which the Prabandha Sanchalak has been appointed are concerned, the same are also dismissed as fresh elections have already been held and the election of Sri Raman Bihari Bharadwaj has been found to be invalid. ————
