Order Heard the parties finally. 2. So far as the payment of monthly allowance from 16.7.2004 till date is concerned, counsel for the petitioner admits that the same has been paid. 3. Now the grievance is that though the Commissioner, Santhal Pargana Division, Dumka directed the Deputy Commissioners, Dumka/Jamtara to hold enquiry with regard to the validity of the appointment of the petitioner and to submit report before him, but the petitioner has not received any order passed pursuant to the said enquiry as yet. 4. Mr. Shamim Akhtar, learned S.C. II appearing for the State of Jharkhand is not in a position to say if the enquiry initiated in December, 2004 has been completed or not. 5. Accordingly, the Deputy Commissioner, Jamtara is directed to send the enquiry report pursuant to the Letter No. 587/Estab. dated 13.12.2004 of the Commissioner, Santhal Pargana Division, Dumka, within four weeks from the date of receipt/production of a copy of-this order, if not already sent. If any decision had been taken by the Commissioner, it should be communicated to the petitioner. Otherwise, the Commissioner will take a decision on the report, if already sent/to be sent and communicate the same to the Deputy Commissioner and the petitioner within four weeks. 6. In the facts and circumstances of the case, the show cause filed by the District Panchayat Raj Officer, Deoghar (respondent no. 5) who is present in Court is accepted. 7. With these observations and directions, this writ petition is disposed of. 8. Let a copy of this order be handed over to Mr. Shamim Akhtar, learned S.C. II, as prayed.
