JUDGMENT Hon’ble Barkat Ali Zaidi, J.—Applicant Qadeer is detained in jail in case Crime No. 686 of 2008 on charges under Sections 363, 365, 366 and 376, I.P.C. Police Station Malhipur, District Shrawasti against him. 2. He has, therefore, come here for bail pending trial. 3. Heard Sri Nisar Ahmad Advocate for him and Sri J.R. Khan, Addl. Government Advocate for the State. 4. Trading in human beings can still be seen though rarely. Here is an example. The father and mother of the girl sold her to the accused as has been disclosed by the girl in her statement before the Magistrate under Section 164 Cr.P.C. and that is how she happened to be with the accused from where she was recovered by the police. Even then, the father had temerity to lodge a First Information Report against the accused. The crime of the father is greater than that of the accused, and he deserves to be prosecuted in accordance with law. 5. As regards the accused, he certainly is guilty even as a purchaser, but the age of the girl according to medical examination report is around 18 year. The girl has said in her statement under Section 164, Cr.P.C. that whatever was done with her by the accused was with her consent and according to Medical Examination Report she is above the age of consent. It was pointed out by the Counsel for the State that age of the girl according to the School record where the girl was a student of Class V, her age was 15 year one month and 23 days at the time of occurrence and thus she was below the age of 16 and thus below the age of consent. 6. It is common knowledge that ages in the school of students are generally under stated and the Medical Examination Report is more dependable. 7. In view of the aforesaid circumstances, the accused may be granted bail. The applicant (accused) be released on bail on his furnishing a personal bond of Rs. Fifteen Thousand with one surety in the like amount to the satisfaction of Chief Judicial Magistrate, Shrawasti. ———
