JUDGMENT 1. - Heard the learned counsel for the applicant and the learned Public Prosecutor and also perused the case diary. 2. An FIR has been registered against the applicant herein and others at Police Station City Kotwali, Bhilwara, alleging commission of offences under Sections 420, 467, 468, 471 & 120B IPC. 3. It is submitted that in view of the order passed by the learned Magistrate under Section 202(1) Cr.P.C., the concerned SHO has power to take statements or documents on record but has no power to arrest any accused person without appropriate proceedings being taken by the learned Magistrate under Section 202 to 204 Cr.P.C. It is also submitted that in the instant case after recording the statement of the complainant under Section 200 Cr.PC., the learned Magistrate having inquired into the complaint could not have directed further investigation by the police. In this regard, the learned counsel has relied upon a decision of the Hon'ble Supreme Court in the matter of Bhagat Ram v. Surinder Kumar and Others, (2004) 11 SCC 622 and decision of this Court in the matter of Vinod Baid v. State of Rajasthan & Anr., 2003 (1) RCC 309 . 4. Having regard to the nature of accusation and taking into consideration totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to extend protection to the accused applicant under Section 438 Cr.PC. 5. Consequently, the I.O./S.H.O. of Police Station Kotwali, Bhilwara is directed that in the event of arrest of the applicant Suresh Chandra S/o Late Ghishu Lal in FIR No. 782/2004, he shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs. 20,000/- with two sound and solvent sureties of Rs. 10,000/- each to the satisfaction of the I.O./S.H.O. on the following conditions: (1) He shall make himself available for interrogation by Investigating Officer as and when required; (2) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer. (iii) He shall not leave India without the previous permission of the vial court. Bail Application Allowed. *******
