JUDGMENT 1. - Heard learned counsel for the parties and perused the record of the case. 2. Learned counsel for the petitioners submits that a civil suit in regard to plot in dispute is pending before the civil court wherein temporary injunction application was also decided. In the FIR it has been stated that plot in dispute originally allotted to Damodar and power of attorney has been executed by him in favour of Babulal Meena, who is brother of complainant. It is stated that when the FIR was lodged by the petitioner in regard to same land, then final report was given by the police in view of the pendency of the civil suit, thus looking to the aforesaid, the petitioners are entitled to grant bail under Section 438 Cr.PC. 3. On the other hand, learned Public Prosecutor has opposed the bail application. 4. After taking into consideration the rival submissions of the parties and without expressing any opinion on merits of the case, which may otherwise effect the outcome of the trial, but looking to the facts of this case, I allow this bail application under section 438 Cr.PC. 5. Therefore, the SHO/I.O. of the Police Station Vaishali Nagar, Jaipur City South, Jaipur is directed that in the event of arrest of the petitioners-Pawan Choudhary s/o Ranjeet (Randhir) Singh Choudhary Vijendra Dhillo s/o Hoshiyar Singh Dhillo, Madan Verma s/o Bheru Lal Verma and Mahaveer s/o Likma Ram in FIR No. 367/08 registered for offence under Sections 420, 467, 468, 471, 120-B I.P.C., he shall enlarge them on bail provided each of them furnishes a personal bond in the sum of Rs. 50,000/- each with one surety in the like amount to his satisfaction on the following conditions : (i) They shall make themselves, available for interrogation by Investigating Officer as and when required; (ii) They shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer; - (iii) They shall not leave India without the previous permission of the Court; (iv) They shall not commit same and similar offence during the period of bail.
