Judgment :- 1. This appeal is focussed as against the judgment and decree dated 310. 1994, passed by the learned XIV Asst. Judge, City Civil Court at Madras in O.S. No.572 of 1988. 2. When the matter is taken up for hearing, both sides presented a memo dated 21.07.2008, which is reproduced hereunder for ready reference. "The Appellant and Respondents 1 to 5 hereby affirm the Sale Deed dated 26.02.1981 registered as Document No.1210 of 1981 in the office of the Sub Registrar, Kodambakkam executed by the Respondents 1 and 3 to 5 in favour of the 6th Respondent in respect of property sold to him. All the parties pray that the appeal may be dismissed without order as to costs in the appeal." 3. As per the above memo it appears that the appellant and respondents 1 to 5 agreed that the sale deed dated 26.02.1981 registered as Document No.1210 of 1981 in the office of the Sub Registrar, Kodambakkam executed by the respondents 1 and 3 to 5 in favour of the sixth respondent, in respect of the property sold to him is a genuine one. Accordingly, they prayed for the dismissal of the appeal. Hence, recording the same, the appeal is dismissed. However, there will be no order as to costs.
