JUDGMENT 1. - Heard learned counsel for the parties and perused the record of the case. 2. Learned counsel for the petitioner submits that initially when the statements of the prosecutrix were recorded on her recovery, no allegation was made against present petitioner rather all allegations were made against one Vikram Singh as prosecutrix remained with him for many days and visited as many as 8-10 places and during that period allegation for commissioning of rape was made against him but then while statement of prosecutrix under Section 164 Cr.P.C. was recorded, further allegation was made against the present petitioner also though allegation against Vikram Singh was maintained by the prosecutrix. It is stated that the prosecutrix had relation with Vikram Singh and so far as petitioner is concern, he has falsely been implicated In the matter in regard to commissioning of offence under Section 376 I.P.C. otherwise allegation against him initially was for dropping Vikram Singh and prosecutrix at Dadri Railway Station, thus looking to the aforesaid, the petitioner may be enlarged on ball as otherwise he is behind the bars for last six months. 3. On the other hand, learned Public Prosecutor has opposed the bail application. 4. After considering the rival submissions of the parties and without expressing any opinion on merits of the case, which may otherwise effect the outcome of the trial, but looking to the facts of this case, I am of the view that the petitioner deserves to be enlarged on bail and accordingly, the bail application is accepted and I consider it just and proper to release the accused-petitioner namely, Mahendra Singh s/o Rajendra Singh on bail under Section 439 Cr.P.C. in FIR No. 185/08 registered at Police Station Pilani, Jhunjhunu for offence under Section/s 363, 366(K), 376(2)(G), 120B I.P.C. provided, he furnishes a personal bond in the sum of Rs. 50,000/- together with one surety in the like amount to the satisfaction of the learned trial Court for his appearance before that Court on all subsequent dates of hearing and as and when called upon to do so.Bail Application Allowed. *******
