JUDGMENT 1. - This review petition has been presented seeking review of the Judgment dated 20.12.2006 whereby fourty seven writ petitions came to be disposed of including S.B. Civil Writ Petition No. 9278/2002 whereby the cause of the petitioner came to be dismissed wherein the challenge was to the rejection of his application by the respondents seeking compassionate appointment on the death of his father, working as Peon with the respondent, Department of Education. 2. Review has been sought on the ground that the father of the petitioner died in harness on 31.12.1995 and the petitioner at the time of death of the father was of 15 years of age. He filed an application for compassionate appointment on 16.03.1996 which was rejected on 15.06.1998, while the petitioner at the time of the death of the father was not of the age of majority. The submission of the learned counsel for the petitioner is that the Court has committed error on the face of the record in maintaining order of the respondents despite the fact that the respondents vide their Circular dated 13.12.2000, had clarified that the.dependant of the deceased can seek consideration till 16.09.1998 whose parents died in 1 harness on or before 04.01.1997. This Circular has been annexed as Annexure-9 with the writ petition. 3. The application of the petitioner was rejected by the respondents on the ground that it has not been filed within a period of 45 days from the date of death of the father, in terms of the limitation period provided in 1 the Rajasthan Compassionate Appointment of Dependants of the Deceased Government Service Rules, 1996. These rules came into effect on 15.01.2000 whereas the application was presented before the rules came into effect. The application was to be considered in accordance with the relevant Rules. Even if the limitation is to be considered, the circular of the respondents provides that till 16.02.1998, the application can be treated to be within limitation. 4. For the aforesaid reason, this review petition is allowed. Consequently, the Writ Petition is also allowed and the order dated 15.06.1998 is set aside. The respondent-Department of Education and ,Other concerned authorities are directed to consider the application of the petitioner in accordance with the rules.Review & Writ Petition Allowed. *******
