ORDER:- Petitioner is a TFT licence holder. The Inspector of Prohibition and Excise, Asifabad Circle, Asifabad, Adilabad District, registered a case in P.R. No.60 of 1995-96 against the petitioner on 23.1.1996 and thereafter a show-cause notice was issued to him for cancellation of the licence. Petitioner made a representation to the Excise Officials to send the second sample to an independent Lab, but no sample was sent to the laboratory. Petitioner's licence is being renewed from time to time. Be that as it may, now the grievance of the petitioner is that though the case was registered in the year 1996, the Excise Officials have not yet filed charge-sheet before the Court concerned. Hence, he seeks to quash the proceedings in P.R. No.60,of 1995-96. 2. Heard the learned Counsel' for the petitioner and the learned Public Prosecutor. 3. The learned Public Prosecutor does not dispute the contention of the petitioner that no charge-sheet is yet filed in the said case registered against the petitioner. It is really unfortunate that though the crime was registered as early as in the year 1996, so far, the Inspector of Prohibition and Excise, Asifabad, has not chosen to complete the investigation, and file charge - sheet. When such is the situation, this Court has no hesitation to come to the conclusion that the authorities are not interested in getting the matter prosecuted. 4. Therefore, the criminal petition is allowed and the proceedings initiated against the petitioner in P.R. No.60 of 1995-96 of Prohibition and Excise Station, Asifabad Circle at Asifabad, Adilabad District, are hereby quashed.
